Unfair Dismissal
Unfair dismissal can be overwhelming and distressing. In New Zealand, dismissals are generally assessed on two key aspects:
process and reason.
Fair Process
Employers are expected to follow a fair and reasonable process when ending employment. This typically includes communicating concerns, allowing the employee to respond, and considering alternatives before making a final decision.
Good Reason
Employers must also have a genuine and reasonable basis for ending employment. Employees have the right to request the employer’s reasons in writing and to challenge those reasons if they believe the dismissal was unjustified.
